SMS Privacy POLICY

Effective Date: January 1, 2026

Annex Automotive Organization LLC ("Annex Automotive," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you interact with our business, including when you contact us via SMS text message, visit our Colorado location, or use any of our services.

This Policy is intended to comply with the Colorado Privacy Act (CPA), C.R.S. § 6-1-1301 et seq., as well as all other applicable federal and state laws. By contacting us, using our services, or opting into our SMS communications, you agree to the terms described below.

1. Information We Collect

b. Information Collected Through SMS Interactions
When you text us to request a repair estimate or opt into our SMS marketing program, we collect your mobile phone number, the content of your messages, and any information you voluntarily share about your vehicle or service needs.

c. Automatically Collected Information
When you visit our website, we may collect IP address, browser type, pages viewed, and other standard web analytics data through cookies or similar technologies.

d. Sensitive Data
We do not intentionally collect sensitive data as defined under the Colorado Privacy Act (such as biometric data, health information, or precise geolocation). If such data is inadvertently provided, it will be deleted promptly

3. SMS Communications & Text Message Program

Once you opt in, you may receive messages including but not limited to:

Seasonal promotions and discounts
Service reminders (oil changes, tire rotations, inspections)
Flash deals and limited-time offers
Responses to your service inquiries and estimates
Appointment confirmations and follow-ups

c. Message Frequency

Message frequency will vary. You may receive up to 1-2 messages per month depending on promotions and your service activity.

d. Message & Data Rates

Message and data rates may apply. These rates are determined by your mobile carrier. Annex Automotive Organization LLC is not responsible for any charges incurred through your wireless carrier.

e. Opting Out

You may opt out of SMS marketing communications at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message and no further marketing texts will be sent. To re-subscribe, text START to the same number.

4. Sharing of Your Information

We do not sell, rent, or trade your personal data — including your mobile phone number — to third parties for their own marketing purposes. We may share your information in the following limited circumstances:

Service Providers: We may share information with trusted vendors who assist in delivering our services (e.g., SMS platform providers, payment processors). These vendors are contractually required to protect your data and may only use it to perform services on our behalf.
Legal Requirements: We may disclose information if required by law, court order, or governmental authority, including Colorado state agencies.

5. Colorado Privacy Act (CPA) — Your Rights

As a Colorado resident, you have specific rights under the Colorado Privacy Act (C.R.S. § 6-1-1301 et seq.), effective July 1, 2023. These rights include:

a. Right to Access

You have the right to confirm whether we are processing your personal data and to access that data.

b. Right to Correction

You have the right to correct inaccurate personal data we hold about you.

c. Right to Deletion

You have the right to request deletion of personal data you have provided to us or that we have collected about you, subject to certain legal exceptions.

You have the right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format.

e. Right to Opt Out

You have the right to opt out of the processing of your personal data for purposes of: (1) targeted advertising, (2) the sale of personal data, or (3) profiling. We do not currently engage in targeted advertising, the sale of personal data, or automated profiling.

f. How to Exercise Your Rights

To exercise any of your CPA rights, please submit a request to us using the contact information in Section 10. We will respond to verified requests within 45 days. We may extend this period by an additional 45 days when reasonably necessary, with notice to you. We will not discriminate against you for exercising your rights.

g. Right to Appeal

If we decline to act on your request, you have the right to appeal our decision. To appeal, contact us at the information provided in Section 10 and indicate that you are submitting an appeal. If your appeal is denied, you may contact the Colorado Attorney General at coag.gov to submit a complaint.

6. Data RETENTION

We retain your personal data for as long as necessary to fulfill the purposes outlined in this Privacy Policy, maintain service records, comply with Colorado and federal legal obligations, and resolve disputes. SMS opt-in and opt-out records are retained in accordance with applicable telecommunications regulations.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal data from unauthorized access, disclosure, alteration, or destruction, consistent with the requirements of the Colorado Privacy Act. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

In the event of a data breach affecting your personal information, we will notify affected individuals and the Colorado Attorney General as required under Colorado law (C.R.S. § 6-1-716).

8. Cookies and Tracking Technologies

If you visit our website, we may use cookies and similar tracking technologies to improve functionality and analyze usage. You may control cookie settings through your browser. We do not respond to "Do Not Track" signals at this time, but we will update this policy if our practices change.

9. Children's Privacy

Our services are not directed to individuals under the age of 13. We do not knowingly collect personal data from children under 13. If we become aware that we have inadvertently collected such information, we will take steps to delete it promptly in compliance with applicable law.
